Louisiana Auctioneers Licensing Board (LALB) Meeting Highlights
LALB Contemplates Removal of ALL Restrictions from  Ken Buhler's Auction License

Brief Background:

As a result of the March 26, 2013 hearing (in which Estate Auction Services was found guilty of two auction statute violations), the bond of Estate Auction Services was cancelled.  Accordingly, the license for Estate Auction Services became void (a license requires a bond be in place).  Consequently, the status of Ken Buhler's license became jeopardized because his license required him to work directly under and be supervised by his father, Mac Buhler, as owner of Estate Auction Services.  As a result, the LALB convened a special meeting to discuss the removal of ALL restrictions upon the license of Ken Buhler.  The video below contains the highlights of those discussions:

May 20, 2013

LALB Meeting:  May 20, 2013

0:22 - 1:21 Ken Buhler states why he feels the restrictions on his license should be removed.

1:22 - 2:30 Board Member Hal McMillin:  "an injustice has been done for a long time" regarding
the restrictions on Ken Buhler's license.  He further relays, "a bad thing happens for a good thing to happen."

2:32 - 4:19  Marvin Henderson relays why he contends the restrictions on Ken Buhler's license should be removed.

4:46 - 7:03 LALB Attorney Anna Dow reiterates problems which led up to Ken Buhler's license revocation and relays
"
I was seeing some of the same problems now that I saw then." She also expresses reservations that Mr. Buhler has not
paid off his EBRP sales tax obligation.

9:15 - 9:52 LALB Attorney Anna Dow expresses her concerns with any total removal of the restrictions on Ken Buhler's
license and states that her biggest concern is that "
Mr. Buhler will be back here again."

10:00 - 10:23 Ken Buhler expresses his reluctance to permit clients to indicate they desire reserves because "everyone will want to have reserves;"
however, Board Member James Sims indicates he will HAVE to incorporate such provision for reserves on his contracts.

10:25 - 11:08 LALB Member James Sims relays to Ken Buhler that the Board is removing all restrictions on his license except his obligation for past
sales taxes.

11:28 - 12:06 LALB Member Hal McMillin states what he expects of Ken Buhler and warns him that "
after all we've been through" that he
expects Ken Buhler not to be appearing before the Board again anytime soon.
