Lawsuit filed:  CLICK HERE for Burns v. LALB et. al. entailing Defamation Pertaining to LALB "Hearing" of 9/17/12.

 

 

October 22, 2013: 

Larry Bankston and Bankston & Associates, acting in the capacity of Defendants, file a Special Motion to Strike (LA CCP 971) and Peremptory Exception of No Cause of Action.

 

 

October 24, 2013: 

Grant Guillot (Shows, Cali) files a Declinatory Exception of Lis Pendens on behalf of Defendants LALB, Charles "Hal" McMillin, Greg Bordelon, Darlene Jacobs-Levy, and Charles "Clayton" Brister.  Noticeably absent from the list of Defendants being represented by Shows, Cali are Chairman Steinkamp and Vice Chairman James Sims. 

 

 

January 13, 2014: 

Plaintiff Burns files Memorandum in Opposition to Bankston's Special Motion to Strike and No Cause of Action.  Hearing is set for February 3, 2014.

 

Plaintiff Burns files Memorandum in Opposition to Mr. Guillot's Declinatory Exception of Lis Pendens.  As with Bankston's Strke Motion, hearing is set for February 3, 2014.

 

January 30, 2014: 

 

Grant Guillot files this last-second "reply memorandum" to Burns' Opposition Memorandum.

 

February 3, 2014: 

 Oral arguments heared by Judge Hernandez, who indicates he is taking the matter under advisement and will issue his ruling at a subsequent date.

 

 

END RESULT

 

April 3, 2014: 

 

Judge Hernandez grants Defendants' declinatory exception of lis pendens and thereby declares the peremptory exception filed by Mr. Banskton moot.

 

April 9, 2014: 

 

Grant Guillot (Show Cali) submits judgment merely dismissing case with prejudice; however, Larry Bankston (through Jenna Linn) wishes the language "at plaintiff's cost" be added.  Burns vehemently objects

 

April 14, 2014: 

 

Judge Hernandez ultimately signs the judgment without adding the words "at plaintiff's cost."
